To me it is a very fair and reasonable judgement. Sishuwa must be very careful. Even his employers might take notice of his wiered reasoning and no employer would like to be associated with such. Sishuwa is simply unreasonable. He just needs to careful or his article will be the rope that he uses to hang himself in terms of career progression. There is nothing academic in those articles but childish behavior.

Is it true that only the 2016 presidential dispute is what has cost them today? If the entire panel was unqualified or misconducted themselves, then all their past judgements must be null and void.

But the way they were always ruling in favour of PF when it was in power including the fact that they ruled in favour of lungu going for the third term when in fact he had already been sworn in twice was also wrong. Let this be a lesson to all judges to always do the right thing and not what their paying masters want even if it means losing your job.

The constitution definitely needs to be re-written. At present it is not DEMOCRATIC. It has given the President too much power. We are not China or Saudi Arabia. We removed Kaunda because we wanted a democracy

Indeed why does the President have to be the one who promotes Judicial staff like Shilimi? The Judiciary’s adminstrative or operational chores should be done internally. That can only mean the President has very wrongly been given power to meddle in the Judiciary. It certainly cant be democratic.
I thought John Sangwa had argued that the judges in this court did not meet minimum requirements such as 15 years experience and he was dismissed.

He recognised that his client HH was behind these shenanigans and could not be party to it. These judges may not have been qualified to sit on the Constitutional court, that we know because John Sangwa wrote about it- but the system is so broken that politics trumps the law. In Zambia, the President can ride rough shod over the constitution and his ape MPs and judges will cast a blind eye and rubber stamp everything. We need to make this impossible in a new constitution.

@independent,,,In 2016, the Concourt judges just sat back and waited for the 10 or so period before claiming that time for hearing the petition had elapsed. Meanwhile, Max Chongu and his band of rascals were camped at the twin roundabouts opposite the concourt waiting to literary lynch HH if he showed up. Plain recklessness by ECL who was complicit in the whole thing!

I agree.Sishuwa seems to be on tera feme only as an academician and historian .In reality, however ,he fails to note that a constitution all over the world is a political document crafted by politicians and not the masses whose views it claims to present. The difference between the powers that be between us and those in the developed (civilized) world is that, those fellows have developed an advanced culture of conscientiousness and restraint such that their checks and balances in governance seem miraculous. These values and virtues you do not acquire by books alone. They are too subtle and fliting for dullards like DejaFooool to discern
